1. Definitions
In these Terms & Conditions, the following definitions apply:
- Cooling-off period: the period during which a consumer may cancel the agreement without giving a reason.
- Consumer: a natural person not acting in a professional or commercial capacity who enters into a distance agreement with the seller.
- Day: calendar day.
- Long-term agreement: a contract for regular delivery of products or services over time.
- Durable medium: any tool that allows information to be stored in a way that it can be accessed and reproduced unchanged in the future.
- Right of withdrawal: the consumer’s right to cancel a contract during the cooling-off period.
- Model form: the withdrawal form made available by the seller.
- Seller: the person or business offering products or services remotely.
- Distance agreement: an agreement made exclusively through one or more means of remote communication (e.g. email, webshop).
- Remote communication: tools like email, websites, or other platforms that allow contracts to be concluded without being physically present together.

3. Applicability
- These terms apply to every offer and agreement between the seller and the consumer.
- Before completing a purchase, the consumer will have access to these terms. If not reasonably possible, the seller will indicate how the terms can be reviewed or sent.
- If the contract is concluded electronically, the terms will be provided in a downloadable or storable digital format.
- If specific product/service conditions also apply, the consumer may rely on the more favorable terms.
- If any part of these terms is invalid or nullified, the remainder stays in effect.
- Situations not covered by these terms should be interpreted in the spirit of these conditions.
4. The Offer
- Offers will include clear descriptions and, where applicable, realistic images.
- The offer will mention if it has limited validity or special conditions.
- Pricing, taxes, shipping costs, payment methods, return rights, and the process to place an order will be clearly explained.
- All images and details are indicative; actual products may vary slightly.
5. The Agreement
- The agreement is binding once the consumer accepts the offer and meets the conditions.
- If accepted electronically, the seller will confirm receipt promptly.
- The seller takes appropriate security measures for electronic transactions.
- The seller may check the consumer’s ability to pay. If there’s reason to refuse an order, this will be communicated.
- The consumer will receive confirmation with:
- Seller’s address
- Return policy
- Warranty info
- Terms of cancellation (if long-term contract)
6. Right of Withdrawal
For physical products:
- You may cancel the purchase within 14 days of receiving the product without giving a reason.
- During this period, handle the product carefully and only unpack it as needed to evaluate it.
- To withdraw, notify the seller (preferably in writing or email) and return the product within 14 days.
- If no withdrawal notice or return is made after this period, the purchase becomes final.
For services:
- Services can be cancelled within 14 days of agreement unless explicitly started with consumer’s consent before this period ends.
7. Costs in Case of Withdrawal
- If you cancel, you pay only the return shipping.
- Any amount already paid will be refunded within 14 days, provided the product is returned or proof of return is shown.
- Refunds will be made using the original payment method unless otherwise agreed.
- You’re liable for any loss in value if the item is returned in used or damaged condition.
8. Exclusion of the Right of Withdrawal
The right of withdrawal does not apply to:
- Custom-made or personalized items.
- Items that cannot be returned for hygienic reasons or perish quickly.
- Digital downloads or opened sealed media (e.g. audio, video, software).
- Services already fulfilled during the withdrawal period with prior consent.
9. Prices
- Prices include VAT unless stated otherwise.
- Prices may change due to legal VAT changes.
- No price increases within 3 months of purchase unless required by law.
- Typos or pricing errors do not oblige the seller to fulfill the order.
10. Conformity and Warranty
- Products must match their descriptions and be fit for normal use.
- Any agreed special features or uses must also be met.
- Faulty or incorrect items must be reported within 2 months of delivery.
- Warranty is in line with what the supplier/manufacturer provides.
11. Delivery and Fulfilment
- Orders are handled with care and shipped to the address provided.
- Unless otherwise agreed, delivery takes place within 30 days.
- If delay occurs or delivery fails, the consumer may cancel the order and be refunded.
- Risk of loss or damage transfers to the consumer upon delivery.
12. Long-Term Agreements
Cancellation
- You may cancel an ongoing contract with a one-month notice.
- Fixed-term contracts may be cancelled at the end of the period with the same notice.
Renewal
- Contracts are not automatically renewed for a fixed period.
- Newspaper/trial subscriptions may be extended once for up to 3 months.
Duration
- Contracts over one year can be cancelled after 12 months at any time with one month’s notice.
13. Payment
- Payment must be completed within 7 business days unless otherwise agreed.
- Errors in billing details must be reported immediately.
- In case of late payment, the seller may charge reasonable collection costs.
14. Complaints
- Complaints must be submitted clearly and within 2 months of discovering the issue.
- You’ll receive a response within 14 days. If more time is needed, you’ll be notified.
- Unresolved complaints may be submitted via the EU’s ODR platform: http://ec.europa.eu/odr
- Filing a complaint does not suspend payment obligations.
- If a complaint is justified, the seller may replace or repair the item at no cost.
15. Disputes
- These terms are governed by Dutch law, even if the buyer lives abroad.
- The Vienna Sales Convention (CISG) does not apply.
16. Additional Provisions
- Any additional or deviating clauses must not disadvantage the consumer and must be recorded in writing or in a way that can be stored and accessed later.
